Attorney Wright Said No!

Attorney George Wright said no! The attorney for the Mountain Electric Cooperative Board of Directors wrote I am NOT entitled to review and copy any records of the Mountain Electric Cooperative.

Mr. Wright provided a written response to my requests for records. He said “no” to every request. Most importantly, Mr. White cited Tennessee law as the basis for his denials.

Attorney Wright cited the statute I quoted in my statement deals with corporations formed and existing under the Tennessee Nonprofit Corporation Act. However, the MEC was and is organized under the Tennessee Rural Electric and Community Services Cooperative Act. Mr. Write wrote this was codified under TCA §65-25-201 et seq. Since no such statute exists, I presume he meant to reference TCA §65-25-101.

Mr. Wright wrote that TCA §65-25-225 specifically states certain identified sections of the Tennessee Nonprofit Corporation Act do not apply to cooperatives incorporated under or otherwise subjected to §65-25. Therefore, I am NOT entitled to review and copy any records of the Mountain Electric Cooperative. Once again, no such statute exists, so I presume he meant TCA §65-25-125.
